Planning Conditions

The most recent documents relating the variation and discharge of conditions from the orignal planning and listed building consents, as discussed and agreed with CAG, are shown below. 

An explaination for each application is summarised below and the BCC documents are shown as PDFs below the text:

• 17/04438/X – ‘S73’ application to vary condition nos. 2, 3, 4, 11, 18, 19, 20, 22, 23, 24 & 43 of the original planning permission.

Following an inspection of the Carriageworks building by the demolition contractor, it became clear that it was not safe or feasible for site operatives to enter the building, or remove rubble from inside, whilst the rear wall and internal structure remained in situ.  As such, this application sought to include those elements (rear wall and internal structure) on the demolition plans.  The main façade fronting Stokes Croft is to be retained and the overall design and appearance of the scheme will not change – the rear wall and internal structure will simply be rebuilt rather than retained. 

The application also sought to amend the wording of certain conditions that required the submission of details (material samples, contamination reports, BREEAM details, SUDs etc.) prior to demolition.  The revised wording ‘pushes back’ the submission of these details until the demolition is complete i.e. prior to construction.  This makes it easier for the various site investigation works to take place and will ensure the planning permission can be implemented ahead of its upcoming expiry date in July 2018.

•  17/04561/X – ‘S19’ application to vary condition nos. 4 & 5 of the original listed building consent

This application was submitted in tandem with the ‘S73’ application mentioned above.  Conditions 4 & 5 on the original listed building consent are duplicates of conditions 18 & 43 on the Planning permission.  As such, this application was required to bring both into line.

• 17/05189/COND – application to discharge conditions 5, 6, 8, 11, 12, 17 from the original planning permission. 

These conditions required that certain details be approved prior to the commencement of development.   A Construction Environment Management Plan, various ecological reports, an Employment Strategy and 2 x Archaeology reports were submitted to address the relevant conditions. 

All 3 applications have now been approved and a Deed of Variation to amend the extant S106 Agreement has been completed. All key documents are attached for ease of reference. Conditions 5, 6, 8, 11, 12, 17 now discharged under application ref. 17/05189/COND do not appear on the revised planning permission, the ‘S73’ decision notice (ref. 17/04438/X).  These conditions have been dealt with to the satisfaction of the LPA and therefore the Planning Officer has removed them to avoid unnecessary duplication.
